1. Acceptance of Terms

By downloading, installing, or using Degustador (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). The App is operated by Hologram Systems (hologram.mx). If you do not agree to these Terms, do not use the App.

2. Description of Service

Degustador is a mobile application that enables users to discover, share, and explore food recommendations, including restaurants, dishes, and culinary experiences. Features may include personal taste profiles, social discovery, and curated recommendations.

We reserve the right to modify, suspend, or discontinue any part of the App at any time without prior notice.

3. Eligibility

You must be at least 13 years of age to use the App. By creating an account, you represent that you meet this requirement. If you are under the age of majority in your jurisdiction, you confirm that you have obtained parental or guardian consent.

4. Account Registration

Access to the App requires account registration via a phone number. You agree to:

• Provide an accurate and valid phone number.
• Keep your account credentials confidential.
• Notify us immediately at support@hologram.mx if you suspect unauthorized access to your account.
• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Prohibited Content and Conduct

When using the App, you agree not to:

• Post, share, or transmit content that is abusive, threatening, harassing, hateful, or discriminatory on the basis of race, ethnicity, gender, sexual orientation, religion, disability, or any other characteristic.
• Upload or share obscene, sexually explicit, or otherwise inappropriate content.
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
• Submit false, misleading, or fraudulent reviews or recommendations.
• Use the App to send unsolicited messages, spam, or promotional content.
• Attempt to gain unauthorized access to any part of the App or its infrastructure.
• Scrape, crawl, or systematically extract data from the App without written permission.
• Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
• Engage in any conduct that interferes with or disrupts the experience of other users.

We may remove any content that violates these Terms and take appropriate action against the responsible account, including permanent termination, without prior notice.

6. User-Generated Content

You retain ownership of any content you submit to the App (such as reviews, photos, or recommendations). By submitting content, you grant Hologram Systems a worldwide, royalty-free, non-exclusive license to use, display, reproduce, and distribute that content within the App and related services.

You represent that you have the right to submit any content you post and that such content does not infringe the intellectual property or other rights of any third party.

7. Intellectual Property

All content, branding, design, software, and technology comprising the App — excluding user-generated content — are the exclusive property of Hologram Systems or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, modify, or distribute any part of the App without prior written consent.

8. Third-Party Services

The App may integrate with or link to third-party services (such as WhatsApp for authentication). These services are governed by their own terms and privacy policies. Hologram Systems is not responsible for the practices or content of any third-party service.

9. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee the accuracy, completeness, or reliability of any food recommendations or user-submitted content available through the App.

Food recommendations are subjective and may not account for individual dietary needs, allergies, or health conditions. Always exercise personal judgment and consult a healthcare professional when necessary.

10. Limitation of Liability

To the fullest extent permitted by law, Hologram Systems and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the App, even if we have been advised of the possibility of such damages.

11. Termination

We reserve the right to suspend or terminate your account and access to the App at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the App ceases immediately.

You may delete your account at any time from the Edit Profile view in the app by tapping the "Delete account" button.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will notify you via WhatsApp to the phone number associated with your account and update the "Last updated" date at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Mexico, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of Mexico City, Mexico.
